These Terms of Use ("Terms") govern your access to and use of getsystemm.com and any related newsletters, member services, and digital properties operated by SYSTEMM HOLDINGS ("SYSTEMM," "we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old to create a member account or purchase a subscription. By using the Services, you represent that you meet this requirement and that any information you provide is accurate.

2. Accounts and Subscriptions

Some features of the Services require a member account or a paid subscription. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use. Paid subscriptions renew automatically until canceled. You can cancel at any time from your account settings or by emailing hello@getsystemm.com. Fees already paid are non-refundable except where required by law.

  • Copy, reproduce, distribute, sell, license, or create derivative works of any content from the Services, except as expressly permitted.

  • Upload or transmit content that is unlawful, defamatory, infringing, obscene, harassing, or otherwise objectionable.
  • Impersonate any person or entity or misrepresent your affiliation.
  • Use the Services to send spam, malware, or other harmful code.

The Services, including all editorial content, branding, design, code, images, and other materials, are owned by SYSTEMM or our licensors and are protected by copyright, trademark, and other intellectual property laws. 5. User Submissions

If you submit content to the Services (for example, comments, questions, or feedback), you grant SYSTEMM a perpetual, irrevocable, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, distribute, and display that content in any media, in connection with the Services and our business. You represent that you own or have the right to grant this license and that your submission does not violate the rights of any third party.

Nothing on the Services constitutes medical, professional, legal, or financial advice, and no doctor or patient relationship is created by use of the Services. TO THE FULLEST EXTENT PERMITTED BY LAW, SYSTEMM DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. SYSTEMM MAKES NO WARRANTY REGARDING THE HEALTH, FITNESS, OR PERFORMANCE OUTCOMES OF ANY PROTOCOL, PRACTICE, OR RECOMMENDATION DISCUSSED IN THE SERVICES.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SYSTEMM AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES, EVEN IF SYSTEMM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO SYSTEMM IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100). 12. Governing Law and Disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in New York County, New York, and the parties consent to the personal jurisdiction of those courts. To the extent permitted by law, you waive any right to a jury trial and to participate in a class action.

We may update these Terms from time to time. Material changes will be reflected in the "Last updated" date at the top, and we may provide additional notice where appropriate. Your continued use of the Services after the effective date of any change constitutes your acceptance of the updated Terms.
